Cycling UK terms and conditions for users of the Inclusive Cycling Experience (the inclusive cycle rental scheme/inclusive cycle loan scheme)

1. Introduction

1.1. These terms and conditions apply to your booking for an ‘Inclusive Cycling Experience’ event (“Event”) under the Inclusive Cycle  Experience programme (“Programme”).  

1.2. By booking a place at the Event, you have confirmed that you would like to attend the Event and we have agreed to admit you to the Event and supply you with an inclusive cycle (“Inclusive cycle”), accessories and attachments for use during the Event, as set out in your separate booking confirmation.    

1.3. The Event and your use of an Inclusive cycle and any supplied accessories (including lights, locks, and helmets) will not last for longer than a maximum of 2 hours and is provided to you free of charge.  

1.4. By booking the Event and by ticking the relevant box on our booking management system, you agree to comply with and be bound by these terms and conditions (“Terms”).  

1.5. Separate terms and conditions may apply to any loan of an Inclusive cycle, which we will make available to you separately.  

1.6. Please note that if you breach any of these Terms, we may refuse to allow you to enter the Event and/or require you to leave the Event.  

2. Information about us and the scheme

2.1. We are Cyclists’ Touring Club (trading as Cycling UK) incorporated and registered in England and Wales with company number 25185 and registered as a charity in England and Wales with charity number 1147607 and in Scotland with charity number SC042541 whose registered office is at Parklands, Railton Road, Guildford, Surrey GU2 9JX (“Cycling UK”).  

2.2. The programme will raise awareness of active travel options, increase independence and travel confidence of disabled people, shape inclusive active travel policy, and improve vehicle and equipment supply through loans of non-standard cycles (NSCs) and events based from mobility hubs. We have received funding from the Motability Foundation to deliver the Programme.  

2.3. You can contact us with any questions relating to these Terms, your Inclusive cycle, the Event and/or the Scheme.  

3. Event booking

3.1. To book a place at an Event, you must:  

3.1.1 Be aged 16 years or over;  

3.1.2. Be able to take part in the activity under the guidance of Cycling UK’s trained activity leaders.  

3.1.3. Ensure that all data provided by you during the booking process is accurate, complete and not misleading;  

3.1.4. Agree to these Terms.  

3.2. We reserve absolute discretion to refuse your booking request to attend the event.  

3.3. You must provide proof of your identification upon attendance at the Event (e.g., driving license, passport, UK Biometric Residence Permit (BRP), Asylum Registration Card (ARC), non-UK national ID card etc. or a staff /student ID pass for an Event delivered at your workplace or education setting , and you must also bring your booking confirmation with you. Photo ID is preferred, but we will also accept a utility bill, council tax bill, or bank statement issued within the last 3 months if you have no photo ID, and it shows your full name and address.  

3.4. The Event commences and finishes at the date and time as stated on your booking confirmation.  

3.5. For monitoring and evaluation purposes, Event bookings must be made individually. Each booking is valid only for the individual named upon the booking confirmation and if applicable, for a carer or responsible person to book on their behalf. An additional cycle may be made available for a carer or responsible person alongside the person booked on to the Event. For the avoidance of doubt, participants are eligible to attend more than one Event.  

3.6. You agree to participate in our monitoring and evaluation process, which includes a pre-Event survey and one post-Event survey. You can respond anonymously to the surveys.  

3.7. Following your participation in the Event, Cycling UK may contact you to invite you to take part in further research into the Scheme, the Event, and your participation in it.  

4. Your obligations

4.1. When attending an event, you must:  

4.1.1. Comply with these Terms and all applicable laws;  

4.1.2. Use the Inclusive cycle and any other equipment reasonably and responsibly;  

4.1.3. Use the Inclusive cycle and any other equipment in accordance with all instructions provided by our Event staff;    

4.1.4. Follow all health and safety instructions and guidance as provided to you by our Event staff; and  

4.1.5. Treat Event staff and other participants courteously and respectfully and comply with any instructions or rules put in place by Event staff at the Event.  

4.2 When attending an event, you must not:  

4.2.1. Damage, deface or vandalise the Inclusive cycles or any other material, equipment and accessories provided to you;  

4.2.2. Use the Inclusive cycles for racing, stunt or trick riding;  

4.2.3. Attend the Event while under the influence of alcohol, strong medication or other drugs;  

4.2.4. Take photographs of the Event location, the Inclusive cycles, any participant or our instructor(s) without our express permission;  

4.2.5. Use your mobile phone without our explicit permission;  

4.2.6. Behave in an antisocial, rude, racist, sexist, offensive or aggressive way including (but not limited to) in a manner that causes or is likely to cause alarm, offence or distress to others, or in a way that may amount to harassment towards our Event staff or any other participant.  

4.3. At the end of the Event, you must return to us the Inclusive cycle and any supplied material, accessories or other equipment provided to you during the Event in the same condition they were supplied.  

4.4. We reserve the right, at our absolute discretion, to refuse your participation in the Event and/or remove you from the Event if your conduct is considered by us to be offensive, illegal, threatening, abusive, inappropriate, likely to cause harm, or impair the enjoyment, comfort or safety of other participants, Event staff, any of our agents and/or the general public, or if you otherwise breach these Terms. This includes acting in a way that could cause or is likely to cause damage to property (including, but not limited to, the Inclusive cycles).  

4.5. No compensation will be provided to you if you are removed from an Event in circumstances outlined in clause 4.4 above, and we reserve the right to refuse any further bookings for future Events (or similar) from you or any member of your party.  

4.6. We are not responsible for any damage, loss, delay or expense incurred by you, or any damage, theft or loss of any property, possessions, objects or similar items that you bring to the Event. For the avoidance of doubt, we do not exclude or limit in any way our liability to you where it would be unlawful to do so.  As such, nothing in these Terms excludes or limits in any way our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or for any other matter for which it would be illegal or unlawful for us to exclude or limit (or attempt to exclude or limit) our liability.  

5. Safety and security

5.1. We want you to have a safe and enjoyable experience when attending our Events. In addition to complying with our use requirements outlined in clauses 4.1 and 4.2 above, we request that you exercise caution and good judgment during the Event, and we strongly advise that you wear a helmet and use appropriate safety equipment and clothing when participating in our Events.  

5.2. You accept that cycling has risks and confirm that you  will cycle safely and responsibly at the Event. You  accept that you ride at your own risk.  

5.3. Your personal belongings are your own responsibility when attending one of our Events.  

5.4. All relevant medical information must be provided by you to us prior to attending one of our Events.  You accept that cycling has risks and confirm that you are willing to participate in the programme based on your understanding of the risks and will cycle safely and responsibly at the Event’. 6. Exclusion and suspension

6.1. If you at any time do not comply with these Terms (including, but not limited to, our use requirements under clauses 4.1 and 4.2), and/or any applicable laws, we may exclude or suspend your participation in the Scheme, in addition to any rights we have under these Terms to exclude you from any Event.  

6.2. Where such non-compliance could be of a criminal nature, including (but not limited to) theft of the Inclusive cycles, we reserve the right to refer the matter and disclose all relevant information to the Police. Information obtained by the Police (whether from us or from a third party) may be used to exclude or suspend you from participating in the Scheme.  

6.3. If you are excluded or suspended from the Scheme, we may at our sole discretion cancel your Event booking.  

7. Liability and insurance

7.1. The Inclusive cycles and any accessories remain our property (or the property of our partners, as applicable) during your use at the Event.  

7.2. You are responsible for any loss, theft or damage to the Inclusive cycles and any other materials provided to you for use during the Event.  

7.3. We are not liable or responsible for any delay or failure to perform any of our obligations under these Terms that is caused by events beyond our reasonable control.  

7.4. Cycling UK maintains public liability insurance in connection to the Event.  

8. Data protection

8.1. Our Privacy Policy governs how we may use your personal information. Please review the Privacy Policy carefully.  

9. Cancellation

9.1. You may amend or cancel your event booking by emailing us at inclusivecycling@cyclinguk.org

9.2. You cannot transfer any Event booking to any other individual or change the name listed on the booking confirmation.  

9.3. Your Event booking is conditional upon the Scheme continuing. We reserve the right to cancel any Event booking made by you for any reason, including (but not limited to) the Scheme ending, adverse weather conditions or an inability to safely deliver the event.

11. Updates

11.1. We may change or update these terms and conditions from time to time.  

12. Other

12.1. You must notify us of a change to your contact details as soon as it is practical to do so (and in any event, before the date of the Event), by contacting us by email at inclusivecycling@cyclinguk.org

12.2. Nobody else other than you and us is a party to this agreement. No other person shall have any rights to enforce any of these Terms.  

12.3. You may not transfer or assign any of your rights under these Terms to any other person.  

12.4. Each paragraph of these Terms operates separately. If any court or relevant authority decides that any of these terms are unlawful, the remaining paragraphs will remain in full force and effect to the extent applicable (and construed accordingly).  

12.5. Failure to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.  

12.6. If these Terms are translated into any other language and there is any inconsistency between the versions of the Terms, this English language version shall take priority.  

12.7. These Terms are governed by English and Welsh law and any disputes between us regarding these Terms will be heard in the English and Welsh courts.
